The last year within the lettings industry has without a doubt been busy. Within the coming months, it seems that updates on legislation are set to continue. The government has finally announced that The Electrical Safety Standards in the Private Rented Sector (England) regulations 2020 will be coming into play.

What does this mean for landlords?

For many years its always been a question, “should we, shouldn’t we have our property electrics checked”, this question will no longer need to be asked.  The answer will be YES.

At the moment the dates are still to be confirmed but it’s likely to be either from 1st April 2020 or 1st July 2020 ALL NEW tenancies will need to ensure electrical installation inspections and testing are carried out, and from 1st April 2021 ALL EXISTING tenancies will need to comply.  As per the regulations set, all landlords will need to supply each of their tenants with a copy of the report within 28 days.  All copies must be retained by the landlord and their agent until the next inspection falls due.

We would advise you to start acting on this beforehand, this will help with planning and preparation for landlords, agents, and electrical engineers.

Kings are in discussions with several electrical engineers who are all approved contractors. We will be in contact when we know more to ensure all of our landlords are compliant.

The local authorities will have the power to enforce the regulations that are met by landlords, they will also have the power to arrange and impose remedial action.  Breaches can result in a financial penalty of up to £30,000.
